Terms of Service

1. Acceptance of Terms

By accessing or using The Favorites Game ("Service"), operated by The Favorites Game ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

The Favorites Game is a real-time multiplayer party game where players answer prompts about their favorites across various categories, memorize each other's answers, and then quiz one another. The Service is available as a free tier and a paid subscription tier.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

You may also join games as a guest without creating an account. Guest sessions are temporary and do not persist across visits.

4. Free and Paid Tiers

4.1 Free Tier

The free tier provides access to the core game experience. By using the free tier, you acknowledge and agree that:

  • The Service may display advertisements.
  • We may use your data for advertising and marketing purposes, as described in our Privacy Policy.
  • We may share anonymized or aggregated data with third-party advertising partners for targeted advertising purposes.

4.2 Paid Tier

The paid subscription tier provides a premium, ad-free experience. Paid tier benefits include:

  • A completely ad-free experience across the entire Service.
  • No data is shared with third-party advertising partners.
  • Access to premium features as they become available.

Paid subscriptions are billed on a recurring basis. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

5. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Submit content that is offensive, abusive, hateful, threatening, or otherwise objectionable.
  • Harass, bully, or intimidate other users.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Use automated means (bots, scrapers, etc.) to access or interact with the Service without our written consent.
  • Exploit bugs or vulnerabilities in the Service for unfair advantage or to disrupt gameplay.

We reserve the right to suspend or terminate your account if you violate these conduct rules, at our sole discretion.

6. User Content

You retain ownership of the content you submit through the Service (such as game answers and profile information). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content as necessary to operate and improve the Service.

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.

7. Intellectual Property

The Service, including its design, graphics, interface, and underlying code, is owned by us and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Privacy

11. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time through your account settings.

We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
