Terms of Service

1. Acceptance of Terms

The Favorites Game website and game service (the "Service") is operated by Benjamin Porter ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

The Favorites Game is a real-time multiplayer party game where players answer prompts about their favorites across various categories, memorize each other's answers, and then quiz one another.

3. Eligibility and Account Registration

You must be at least 13 years old to use the Service.

Some games may be marked by their host as allowing mature content ("Mature" games). Mature games are restricted to users who are at least 18 years old. By joining or participating in a Mature game — including by confirming an age prompt shown when joining or during a game — you represent and warrant that you are at least 18 years old. We rely on this representation; providing false age information is a violation of these Terms and may result in suspension or termination of your account.

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

You may also join games as a guest without creating an account. Guest access is temporary: guest accounts expire about 24 hours after they are created, and once expired they are removed from active games and their identifying details are anonymized.

4. Fees, Advertising, and Future Changes

The Service is currently provided free of charge, and we do not display third-party advertising.

We may introduce optional paid features, subscriptions, or advertising in the future. If we do, we will update these Terms and our Privacy Policy before those changes take effect and, for material changes, ask you to accept the updated Terms before continuing to use the Service.

5. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Submit content that is offensive, abusive, hateful, threatening, or otherwise objectionable.
  • Harass, bully, or intimidate other users.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Use automated means (bots, scrapers, etc.) to access or interact with the Service without our written consent.
  • Exploit bugs or vulnerabilities in the Service for unfair advantage or to disrupt gameplay.

We reserve the right to suspend or terminate your account if you violate these conduct rules, at our sole discretion.

6. User Content

You retain ownership of the content you submit through the Service (such as game answers and profile information). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content as necessary to operate and improve the Service.

The Service is a multiplayer game, and gameplay content is meant to be seen: answers and other content you submit during a game are visible to the other players in that game. After a game ends, recap and favorites pages for that game can be shared by link, and anyone with the link can view them — including people who did not play. Do not submit content you would not want other players, or anyone they share the link with, to see.

Submitted content may be screened by automated filters and reviewed when other players report it. We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.

7. Intellectual Property

The Service, including its design, graphics, interface, and underlying code, is owned by us and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your information — including how gameplay content may be processed by third-party AI providers to adjudicate quiz guesses.

We use usage, device, and gameplay data for internal analytics to operate, secure, measure, and improve the Service. This processing is described in our Privacy Policy and is a standard part of using the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Service.
  • Any unauthorized access to or use of our servers or your personal information.
  • Any interruption or cessation of the Service.
  • Any bugs, viruses, or similar issues transmitted through the Service.

To the fullest extent permitted by law, our total liability for all claims arising out of or relating to these Terms or the Service will not exceed the greater of one hundred U.S. dollars (USD $100) or the amounts you have paid us for the Service in the twelve months before the claim arose.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the limitations in this section and Section 9 may not apply to you.

11. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may stop using the Service at any time, and you may delete your account from your profile page or by contacting us, as described in our Privacy Policy.

12. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will notify you — for example, by posting the updated Terms on this page and updating the effective date, by emailing the address associated with your account, or by asking you to accept the updated Terms before continuing to use the Service. Your continued use of the Service after revised Terms take effect constitutes acceptance of the revised Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Idaho and applicable U.S. federal law, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Idaho, and both parties consent to personal jurisdiction and venue in those courts. Either party may instead bring an eligible claim in small claims court.

14. General

  • Severability: If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force.
  • Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, sale of assets, or by operation of law.
  • No waiver: Our failure to enforce a provision of these Terms is not a waiver of our right to enforce it later.
